Terms and Conditions
By booking legal representation online through
all-lawyers.com.au or over the telephone booking service -
Porters Lawyers trading as all-lawyers ("all-lawyers”), you ("the Client")
agree to the following terms and conditions:
- all-lawyers, through their
phone and internet booking service only accept instructions
from clients who are pleading guilty to charges being heard
in a court presided over by a Magistrate (variously described
as a Magistrates Court, Local Court or Court of Petty Sessions
in different Australian states) “Magistrates
Court”.
- all-lawyers accepts the
client's initial instructions
and details and then instructs a law firm that regularly appears
at the court the client will be attending to act on our behalf
as our lawyer agent (“agent”). The agent will
meet the client at court, take their detailed instructions
and appear on their behalf on a guilty plea in a Magistrates
Court.
- The all-lawyers fee covers the client
making one telephone call of a maximum of 20 minutes to
the agent prior to the court date to discuss their case, then
legal representation for a guilty plea on one day in a Magistrates
Court. This legal representation is provided on the basis
that the client checks-in with their all-lawyers agent at
9am at the designated meeting point at the Magistrates court. Instructions
are taken from the client during the previous telephone
call and on that one occasion at the court and not at any previous
meeting. After the all-lawyers agent
appears on the client's behalf, they will explain the Magistrate's
sentence and the client will receive a confirmatory letter
by email.
- The all-lawyers fees do not include meeting
a lawyer on any other occasions other than at the court on
the morning of the appearance before the magistrate. The fee
does not include any advisory correspondence other than the
final emailed letter.
- all-lawyers agent will advise the client of
their legal rights and the implications of making a plea of
guilty.
- The client acknowledges that they
instruct all-lawyers and their agent
that they are pleading guilty of their own free will,
and confirm that they have not been subjected to any
coercion or pressure to plead guilty. The client acknowledges
that the decision to plead guilty is the client's
decision alone.
- The client undertakes that any references they
provide to all-lawyers and their agent for production at court
are genuine and acknowledges that the production of false references
would be a contempt of court and a perversion of the course
of justice that can be dealt with by a magistrate with a term
of imprisonment.
- The client acknowledges and authorises that
the all-lawyers fees paid by credit card through all-lawyers
phone and internet booking service will be paid into and held
in all-lawyers Trust Account.
- The client authorises and directs all-lawyers
to administer any monies held in all-lawyers Trust Account
on their behalf and to:-
- Pay all-lawyers and their agents' accounts
(including GST) in respect of any professional or other
services rendered by all-lawyers and
their agents to the client;
- Transfer any monies from all-lawyers
trust account to all-lawyers general
account and their agent's general account after the provision
of the service and the rendering of an account.
- All correspondence and accounts will be sent by email.
- If the client inputs the wrong court or court
date and the details have to be changed, or the client cancels
the representation after booking, the client agrees to pay
a $22.00 (incl GST) administration fee that the client agrees
will be deducted from their credit card account.
- all-lawyers collects information about the client
so as to provide legal services and process their legal representation
arrangements. all-lawyers may disclose your personal information
to its agents. We do not disclose your details to any other
persons or organisations unless required by law.
- If the magistrate adjourns the matter to a later
date, you will be charged $170.00 incl GST for each subsequent
appearance. This fee must be paid directly to the agent lawyer.
- If for any reason, the client instructs
the agent that they are pleading not guilty, or the magistrate
sets the matter down as a defended matter, the agent
will take instructions to represent the client at the hearing.
The agent will enter a plea of not guilty on the client's
behalf and have a hearing date set. The client will be
charged $150.00 inclusive of disbursements and GST, or
$170.00 inclusive of disbursements and GST if booked by
telephone for this initial court appearance. all-lawyers will
transfer $550.00 from their trust account to the agent's
trust account once a signed authority from the client to transfer
the money is received. The client can use these funds towards
paying the agent to appear at the hearing. The agent will enter
into a separate fees agreement with the client in relation to
the defended matter, and it is the agent's responsibility
to obtain payment and not the responsibility of all-lawyers.
- If for any reason, the magistrate,
after hearing the agent's
submissions, refers the matter to the District/County
or other superior court for the client to be sentenced,
the agent will take instructions to represent the client
at that superior court sentencing. The client will
be charged $150.00 inclusive of disbursements and GST,
or $170.00 inclusive of disbursements and GST if booked
by telephone for this initial court appearance. all-lawyers will
transfer $550.00 their trust account to the agent's trust
account once a signed authority from the client to transfer
the money is received. The client can use these funds towards
paying the agent to appear at the superior court sentencing.
The agent will enter into a separate fees agreement with the
client in relation to the defended matter, and it is the agent's
responsibility to obtain payment and not the responsibility
of all-lawyers. If, however, the client does not engage the
agent to appear at the sentencing at the superior court, then
the agent is entitled to charge the client $550.00 inclusive
of GST for that initial appearance before the magistrate.
- You must be at least 18 years of age to engage
legal representation through all-lawyers.
- These terms do not affect the client's
statutory rights.
